Supreme Court Will Not Consider DACA Challenge

On Tuesday, January 22, the Supreme Court declined to act on the Administration’s plan to end the Deferred Action on Childhood Arrivals (DACA) program, all but ensuring that the Court will not consider the challenge this term. As a result, DACA is to remain in place for the foreseeable future. The move seems indicate that the Court would prefer this issue to be resolved legislatively by Congress. This also removes a potential point of leverage for the President in negotiations to end the government shutdown, making it even less likely that Democrats will accept a proposal to extend temporary DACA protections as part of negotiations.
